Mafuriko, disclaimer and terms of use

01About Mafuriko

Mafuriko is a free public awareness tool operated by Esoteric Strats and powered by AIVERSE (“we”, “us”, “our”). It maps locations in Nairobi with a history of flooding using:

1. Flood hotspots publicly named by Nairobi County, the National Disaster Operations Centre (NDOC) and the Kenya Red Cross;
2. Public records and reports of flooding in previous seasons; and
3. Reports submitted by members of the public.

Mafuriko identifies places that have flooded before or are reported to be flooding now. Any indication that an area is at risk is based solely on this historical and reported information.

02Not a weather forecast or official warning

Mafuriko does not observe, measure or forecast weather, and does not issue weather warnings, alerts or advisories of any kind. Nothing on this site is, or should be treated as, a meteorological forecast or an official warning.

Official weather forecasts and warnings in Kenya are issued only by the Kenya Meteorological Service Authority (KMSA). Official disaster guidance is issued by the National Government, NDOC and county authorities. Where anything on this site conflicts with official guidance, official guidance prevails.

03Risk indications are historical only

Any label, colour, ranking or description suggesting an area is at higher or lower risk reflects only how often flooding has been reported there in the past or is being reported now. It is not a prediction that flooding will or will not occur at any time or place, and it is not a measurement or estimate of rainfall, river levels or any other meteorological or hydrological condition.

04No government affiliation

Mafuriko is an independent initiative. It is not operated by, affiliated with, or endorsed by KMSA, NDOC, Nairobi County, the Kenya Red Cross or any government body. References to these institutions identify the public sources of information and do not imply endorsement.

05Third party rainfall data

Any rainfall information shown is displayed as received from Open-Meteo (open-meteo.com), a third party source, for general context only. We do not produce, alter or interpret this data, and we make no representation about its accuracy. It must not be read as a forecast by Mafuriko. For official rainfall forecasts, refer to KMSA at meteo.go.ke.

06Community reports

Community reports reflect the views of the individuals who submit them. We do not verify reports in real time and are not responsible for their content. Reports may be inaccurate, incomplete, outdated or false. Reports more than one day old are shown as expired.

By submitting a report, you confirm that it is truthful to the best of your knowledge and based on what you have personally seen. You must not submit false, misleading, malicious or alarming reports. We may edit, hide or remove any report at our discretion without notice, and may restrict users who misuse the service. Knowingly spreading false information may carry legal consequences under Kenyan law.

You grant us a free, perpetual, worldwide licence to use, display and share reports you submit for the purpose of operating and improving Mafuriko and supporting flood awareness.

07Privacy and data protection

We process personal data, including the location of reports and any contact details you provide, in line with the Data Protection Act, 2019. We collect only what is necessary to operate the map, do not sell personal data, and display reports without identifying the person who submitted them.

08No warranties

Mafuriko is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including any warranty that the information is accurate, complete, current or fit for any particular purpose, or that the site will be available without interruption or error.

Flooding can occur in places not shown on this map. Places shown may not flood. Locations are approximate. The absence of a marker or report does not mean an area is safe.

09Your responsibility

You use Mafuriko voluntarily and at your own risk. You are solely responsible for your decisions and actions, including decisions about travel, routes, property and personal safety. We have no duty to monitor conditions, to update the map within any period of time, or to notify you of flooding in any area.

Mafuriko must not be used as the basis for decisions about buying, renting, insuring, valuing or developing property, or for any legal, financial or engineering purpose.

10Safety first

In an emergency, do not rely on this site. Move to higher ground, never walk or drive through moving water, and follow instructions from authorities.

11Limitation of liability

To the fullest extent permitted by law, Esoteric Strats, AIVERSE, and their directors, employees, partners and contributors shall not be liable for any direct, indirect, incidental, consequential or special loss, damage, injury or death arising from:

1. use of, or inability to use, the site;
2. reliance on any information on the site, including community reports and third party data;
3. any error, omission, delay or interruption; or
4. any decision made or action taken based on the site.

This applies whether the claim arises in contract, negligence or otherwise. Nothing in this Disclaimer excludes liability that cannot be excluded under Kenyan law.

12Indemnity

You agree to indemnify and hold harmless Esoteric Strats, AIVERSE and their team against any claim, loss or expense, including legal fees, arising from your misuse of the site, any report you submit, or your breach of this Disclaimer.

13External links

The site may link to external websites and services. We do not control and are not responsible for their content, accuracy or availability.

14Changes

We may update this Disclaimer, or change, suspend or discontinue any part of the site, at any time without notice. Continued use after changes means you accept the updated terms.

15Governing law and entire agreement

This Disclaimer is governed by the laws of Kenya, and any dispute shall be subject to the exclusive jurisdiction of the courts of Kenya. If any part is found unenforceable, the rest remains in full effect. This Disclaimer, together with our Privacy Notice, is the entire agreement between you and us about the site.
